UPDATED: Wine & Spirits to Remain Closed for Now - Baldwin ...

Pennsylvania Wine & Spirits stores remain closed through at least the end of Tuesday due to Hurricane Sandy.

The state liquor store in Whitehall Borough's Caste Village?is normally open from 9 a.m. to 9 p.m., Mondays through Saturdays.

Whitehall's store, along with the other state liquor stores, closed early at 3 p.m. on Monday ahead of the hurricane.

Early Inness work uncovered at Dallas art museum

(AP) ? An unsigned painting that has been in the Dallas Museum of Art's collection for more than eight decades and was long-believed to have been composed by another artist was likely created by George Inness, one of America's greatest landscape painters, a curator said.

Experts at the museum had thought the oil on canvas, "In the Woods," from around 1850, was painted by Asher B. Durand, a leading figure of the Hudson River School painters in the mid-19th century who was an early influence on Inness.

But experts at the museum began to question the painting's attribution, prompting American art curator Sue Canterbury to research the origin of the painting. As she considered artists who might stylistically fit, Canterbury turned to Michael Quick's book, "George Inness: A Catalogue Raisonne," where she noticed a pen and ink drawing by the artist that closely resembled "In the Woods."

"My heart leapt. I just couldn't believe it," Canterbury said.

The painting, which features a bucolic forest scene, went on display at the museum on Friday reattributed to Inness. Curators have renamed the painting, "Stream in the Mountains."

Canterbury said the reattribution of the painting is significant because it is from Inness' early years, a period of his long career from which not many works have survived. Inness died at the age of 69 in 1894. Canterbury said he changed his style many times during his career.

"It helps art historians understand what he was doing during this period," Canterbury said.

She said comparing the finished painting with the drawing helps "gives us an idea of his artistic process."

Quick, who called the discovery a significant addition to Inness' body of work, suggested the reason not as many paintings have survived from that early period in Inness' career is because he was not as well known then.

NHL: League rejects players union offer to restart labor talks, putting full season in jeopardy - NHL News | FOX Sports on MSN

Forget about a deal to save a full hockey season: the NHL and the players' association can't even agree to get together to talk.

The union wants anything and everything open for discussion. The league says if the players aren't willing to discuss the offer the NHL presented last week, and has no interest in presenting something new with that proposal as a framework, then there really is nothing to talk about.

It didn't take long for the NHL to fire that message back Tuesday night after the union tried to convince the league to return to the bargaining table on Wednesday.

''I don't anticipate any (talks) taking place for the balance of the week,'' NHL deputy commissioner Bill Daly said in an email to The Associated Press. ''The union has rejected the proposal we made last Tuesday and is not offering another one. We see nothing to be gained at this point by meeting just to meet.''

If that is the case, then there is no reasonable hope that a deal will be struck by Thursday - the deadline Commissioner Gary Bettman set in order to preserve a full 82-game season. Games have already been called off through Nov. 1, and those contests soon could be wiped off the schedule for good.

Following a conference call held by the union's executive board on Tuesday night, the players' association informed the NHL it is willing to meet on Wednesday ''or any other date, without preconditions, to try to reach an agreement,'' the union said in a statement.

The NHL's response wasn't what the union had hoped to hear.

The sides haven't met since the league turned down three counterproposals from the union on Thursday, two days after the NHL's offer that included a 50-50 split of hockey-related revenue. The players' association hasn't shown an inclination to use that offer as a starting point in negotiations, resulting in a stalemate that could last for a while.

''The league is apparently unwilling to meet,'' NHLPA special counsel Steve Fehr said in a statement. ''That is unfortunate, as it is hard to make progress without talking.''

No talks have been scheduled, and no last-minute discussions seem to be on tap.

The developments on Tuesday night came hours after more discourse between the sides on the 38th day of the league's lockout.

While negotiators for the NHL and union kept conversations to a minimum, club officials had a brief window last week to discuss the league's latest proposal directly with their players.

Those secretive discussions didn't produce a breakthrough, but they have inflamed an already unsettled atmosphere. The union hierarchy wasn't informed about the window then, and isn't happy about it.

''Most owners are not allowed to attend bargaining meetings,'' Fehr said Tuesday. ''No owners are allowed to speak to the media about the bargaining. It is interesting that they are secretly unleashed to talk to the players about the meetings the players can attend, but the owners cannot.''

The NHL said Tuesday that team officials were allowed to have temporary contact with players and there were parameters regarding what could be discussed.

''From our perspective, this is a nonissue and a nonstory,'' Daly said Tuesday in an email to The Associated Press. ''There is nothing - legally or otherwise - that precludes club personnel from communicating with their players.''

More important is the lack of productive talks between NHL officials and union leaders. Now it seems unlikely that a full season, which was slated to start Nov. 2, will take place.

Last week, the NHL's most recent contract offer was presented to the union and then publicly released in full. The union returned to the bargaining table last Thursday with its various counterproposals, which also would get to an even split of hockey revenue, but each was quickly rejected by the league.

There is a major divide between the sides over how to deal with existing player contracts. The union wants to ensure that those are all paid in full without affecting future player contracts.

After the NHL released its offer on Wednesday, club officials were given until Friday to speak to players and answer questions they might have about the proposal.

In an internal league memo obtained by The Canadian Press, the NHL stated that those discussions must be limited to the contents of the proposal on the table. It also provided examples of questions that shouldn't be asked of players and noted that straying from the rules could ''cause serious legal problems.''

''You may not ask (a player) what he or others have in mind,'' the memo stated. ''If he volunteers what he has in mind you should not respond positively or negatively or ask any questions but instead refer him to the NHLPA.

''Likewise, you may not suggest hypothetical proposals that the league might make in the future or that the league might entertain from the union.''

This was the first time club officials were permitted by the NHL to talk to players since the lockout took effect Sept. 16.

NY Times public editor calls into question incoming CEO Thompson

NEW YORK (Reuters) - The New York Times public editor has questioned whether the newspaper's incoming chief executive, the former BBC head Mark Thompson, is fit to serve as the company's top official as a scandal shakes Britain's most prestigious broadcaster.

One Wall Street analyst called for the New York Times Co to delay Thompson taking over the company, adding more pressure on executives to address the matter on the company's earnings conference call on Thursday.

The BBC has been damaged by the scandal involving one of its most famous entertainers, the late Jimmy Savile, who is accused of sexually abusing hundreds of women and girls over the course of six decades. Savile, the eccentric host of the "Top of the Pops" music show, died last year at the age of 84.

Thompson held the top job as director general at the BBC from 2004 until September and also held the title of editor-in-chief, according to a description of the Director General's duties on the BBC website.

"How likely is it that (Thompson) knew nothing?" New York Times public editor Margaret Sullivan wrote in a blog post on Tuesday.

"His integrity and decision-making are bound to affect The Times and its journalism -- profoundly. It's worth considering now whether he is the right person for the job, given this turn of events."

A New York Times spokesman declined to comment.

No evidence has emerged in police and parliamentary investigations that shows Thompson knew about the decision to pull the Newsnight program or about Savile's alleged behavior.

Thompson did not respond immediately to an email seeking comment about the public editor's column.

The allegations enveloping the British broadcaster hinge partly on the BBC's decision last year to shelve a show at its flagship "Newsnight" program investigating Savile. Rival broadcaster ITV aired a bombshell report this month about Savile and the claims against him, which were rumored for years.

Last week, Thompson said in a statement, "I was not notified or briefed about the Newsnight investigation, nor was I involved in any way in the decision not to complete and air the investigation.

In her post, Sullivan commended the paper for "reporting this story regularly".

As public editor and a representative of readers, Sullivan writes about issues affecting the newspaper independent from News York Times management, including chairman and publisher Arthur Sulzberger Jr. and executive editor Jill Abramson.

Since stepping into the role in September, she has already made waves including a post that criticized the paper's decision not to publish on the front page a story about a congressional hearing into attacks on a U.S. consulate in Benghazi, Libya, last month in which four Americans were killed.

A representative from Sullivan's office said she declined to comment further on her blog about Thompson. An email sent to Sulzberger seeking comment was not returned immediately.

Sullivan's post on Thompson follows New York Times former executive editor Bill Keller, who wrote a column last week drawing a parallel between Savile and Penn State football coach Jerry Sandusky, who was recently sentenced to what amounts to life imprisonment for molesting children.

The New York Times tapped Thompson in August as CEO -- a role that had been vacant eight months after the company ousted its former CEO Janet Robinson last year.

Thompson is expected to start with the Times on November 12.

The unfolding Savile scandal has also caught the attention of some analysts in the United States.

"The New York Times should delay (Thompson's) start date until there is more clarity," said Doug Arthur, an analyst with Evercore Partners who follows the New York Times.

"It seems to me he will have to attend a hearing in the UK parliament. That is going to be a distraction. It's unfortunate. It's an unexpected complication."

In a hearing with British lawmakers on Tuesday, BBC Director General George Entwistle denied that the BBC helped cover up allegations that Savile preyed on women.

Thompson said the Newsnight investigation was mentioned to him by a journalist at a party last year, but he was later told it was not going ahead for journalistic reasons.

"I was never formally notified about the Newsnight investigation and was not briefed about the allegations they were examining and to what extent, if at all, those allegations related to Savile's work at the BBC," he said in a letter to a British lawmaker on Tuesday.

Thompson added he would be happy to appear in front of the parliamentary committee or any other inquiry in future.

Newsnight's editor, Peter Rippon, stepped aside on Monday after the BBC said his explanation for shelving the story had been "inaccurate or incomplete.

DETROIT Patients treated with an epidural steroid injection for back pain relief are at increased risk of bone fractures in the spine, according to a Henry Ford Hospital study.

Researchers say the risk of fracture increased 29 percent with each steroid injection, a finding they believe raises patient safety concerns.

"For a patient population already at risk for bone fractures, steroid injections carry a greater risk that previously thought and actually pose a hazard to the bone," says Shlomo Mandel, M.D., a Henry Ford orthopedic physician and the study's lead author.

Dr. Mandel recommends that patients being treated with steroid injections be told about the risks associated with future fractures and undergo bone testing.

The study was accepted as a Best Paper to be presented Thursday, Oct. 25 at the annual meeting of the North American Spine Society in Dallas.

Bone fractures in the spine are the most common fracture in patients with osteoporosis, affecting an estimated 750,000 people annually. Roughly 40 percent of women aged 80 and older experience bone fractures in the spine.

Patients are typically treated with anti-inflammatory drugs and physical therapy. If symptoms persist, an epidural steroid is often prescribed to alleviate pain and improve function. However, steroid use has been linked to diminished bone quality.

In a retrospective study, researchers compared data of 6,000 patients treated for back pain between 2007 and 2010 3,000 patients who received at least one steroid injection and 3,000 patients who did not receive injection. The average age of patients was 66 years, and 3,840 were women and 2,160 were men. Researchers also analyzed the incidence of bone fractures in each group. Using the survival analysis technique, researchers found that the number of steroid injections is linked with an increased likelihood of fracture.

Tropical Storm Sandy forecast to miss Florida; new depression forms

Tropical Storm Sandy emerged in the southwest Caribbean on Monday afternoon and for now is projected to remain clear of Florida.

Also, for now, it is not forecast to strengthen into a hurricane.

Meanwhile, a new depression formed in the Central Atlantic but poses little or no threat to land. It forecast to become Tropical Storm Tony either tonight or Tuesday and fizzle by Thursday.

At 11 p.m., Sandy, the 18th named storm of the season, was about 385 miles southwest of Kingston, Jamaica, stationary with sustained winds of 45 mph.

The system is predicted to angle northeast over Jamaica on Wednesday, move over Cuba on Thursday and arrive over the central Bahamas on Friday.

If that prediction holds, it would be about 400 miles east of Miami on Friday, its closest approach to the state.

The system still might come close enough to generate large swells, rough surf, gusty winds and heavy rains, starting on Thursday and continuing into the weekend, the National Weather Service in Miami said.

"As always, it's advised to not focus too much on the center location and eventual track, especially with late-season systems like this," he said, adding the large system might generate nasty weather far from its center.

The storm is expected to bring heavy rain to Jamaica, Cuba and Hispaniola over the next few days. A tropical storm watch has been issued for Jamaica.

With Sandy, the 2012 Atlantic season becomes the fourth busiest on record, tied with 1969, which also saw 18 named storms.

Ahead of this year: 2005 with 28 storms; 1933 with 21; and 2011, 2010, 1995 and 1887 with 19.

Collecting/Harvesting/Reaping: Human souls can be used for two things: the first and second most popular is energy. Demons do not feed physically to survive. A human soul can provide a food source for demons, even if not nearly as strong as the power gained from killing a demon. The second and most popular usage is for extracting aspects of their humanity. Demons may store things such as emotions, memories, sensations, even states of being like innocence, in specially-made crystals. These crystals are made to dissolve in hot drinks and then consumed, allowing the drinker to experience whatever was stored within. The mixing together of crystals is considered foolish, as it can leave demons impaired for days or weeks at a time. There are some demon-run "bars" where not only these drinks are served, but where captured humans will be forced to drink them, usually mixed concoctions, for the demons' entertainment.

Possession: A demon will possess a human for a number of reasons. To do so, they must enter one of the Realms, and from there locate their target and enter them in an incorporeal "spirit form". Once done, the human's mind is generally pushed far down into their subconscious. Humans almost never experience anything, or remember anything, from the periods that they were possessed - that is, assuming the demon left or was banished/exorcised without the vessel being killed. Possessing a human limits the demon's powers by a fraction, the size of which depends on the demon's own power. The stronger the demon, the more of its power will be taken away while it controls a human form. Whenever a demon manifests on Earth physically, and hides its true form, there is always something that makes them recognizable, and not just as a demon. For each demon the mark is unique. It may be the color of their hair, eyes/eye, or some symbol or something on their body. When possessing a human, there is no mark. So, if a demon is being hunted, possessing a human allows a way to hide from their enemies. Other times it is to manipulate humans, driving families to kill each other. When possessing a child the demon's intentions are usually to drive the parents to such a level of grief that they kill their own child, which does no harm to the Demon within. Sometimes, in rare cases, demons share a host's body. They will generally consult the host, offering a sharing of power and even control of the body in return for immortality. There are a few extremely rare cases of humans born with no soul. These empty things are entirely malevolent, and demons who possess them can become ensnared by the body. Of course, stronger demons can always break away, while something as strong as a Greater Devil, Elder Devil or Archdemon could simply kill the soulless carcass and move on.

Banishment/Exorcism: When a demon possesses a human, and it has been uncovered, demons and humans can evict the being from the host shell. Exorcism can be done in many ways, usually with incantations and symbols employed to bind and/or weaken the demon's hold, though the effects these things have are relative to the demon's own power, both mental and supernatural. Banishment is much different, and much harder. The banishing of a demon is not simply the forcing of a demon from a body, but the expelling of a demon from Earth completely. This is only temporary, however, and the length of time is always different, lasting anywhere from hundreds of years to a few seconds. While any demon can be banished or exorcised, Archdemons are known for being stupidly difficult to evict.

Realms: The Realms are artificial dimensions created by powerful, higher-class demons, most commonly Greater Devils, Elder Devils and Archdemons, though some Devils and lesser demons have been known to craft their own domains. The human concept of "Hell" is purely of their own invention - though some ancient demons lay claim to having assisted in the formation of the idea. While some Realms are "hellish", others are very different, all depending on the current ruler's whims.

Power Rings: Power Rings are formed by demons who wish to amass power. By sharing their powers, they immediately become much stronger, and any power gained by one is equally shared by all involved. There is, however, a risk involved. Should one demon in a Ring be slain then the entire covenant will suffer for it, becoming noticeably weaker for it. The oldest known Ring is The Sins, an ancient group of Archdemons who long ago cemented their place amongst demonkind. Their age, knowledge and strength make them nearly untouchable by most other demons and Rings. Called ?demonic psychologists? by some, the Sins long ago mapped out the darker parts of the minds of all beings, naming them the Seven Deadly Sins, and mastered the application of their influences to ruin others. The members of another famous Ring, the Four Horsemen, are currently held as the rulers of Earth.

Teachers' union drops case contesting health insurance law ...

AUGUSTA, Maine ? The union that represents most of Maine?s public school teachers has abandoned its efforts to block a law that requires school districts? health insurers to provide the districts with data on their employees? claims history.

The Maine Education Association said it was dropping its lawsuit against Maine?s insurance superintendent, Eric Cioppa, because it was unlikely to succeed if it kept fighting the law?s implementation in court.

?For financial reasons, it made no sense to continue the lawsuit,? MEA president Lois Kilby-Chesley said in a prepared statement. ?We will comply with the law.?

Gov. Paul LePage welcomed the MEA?s decision. ?School systems can now generate savings from their health insurance programs to reinvest in the classroom instead of wasting time and money fighting frivolous lawsuits,? he said in a statement.

The case centered around a law the Legislature passed and LePage signed last year that allowed school districts to request their employees? aggregate insurance claims history from their insurers so they could more easily shop around for cheaper health insurance coverage.

Nearly all of Maine?s school districts insure their teachers and many of their other employees through the MEA Benefits Trust, which has contracted with Anthem Blue Cross to provide insurance. The MEA plan covers about 70,000 people, said Christine Burke, the Benefits Trust?s executive director.

The MEA last October filed a lawsuit in U.S. District Court in Maine, claiming that forcing Anthem to release employees? claims history would violate the union?s contract with the insurer, and that the employee claims history was the property of the MEA Benefits Trust and couldn?t be taken from the union.

A federal judge in February denied the union?s request for an injunction that would have stopped the state from enforcing the new law. The union subsequently took its case to the First Circuit Court of Appeals in Boston. That court ruled late last month that the union stood little chance of succeeding in its efforts to block the law.

The union decided to drop its lawsuit following that opinion.

?We were just throwing good money after bad in trying to litigate this,? Burke said. ?It just didn?t make sense.?

Burke said about 70 school districts so far have requested the claims history for their employees. It?s uncertain, however, whether that means many districts will end up pursuing coverage outside of the MEA Benefits Trust.

If many districts end up leaving the MEA plan, Burke said, the districts that stay will inevitably be those that are more expensive to insure.

?If a number of the good-performing districts decide to go off on their own, we?ll have difficulty staying afloat,? she said. ?We?re going to fight really hard to stay alive. We have to show the districts the value of staying with the trust.?

Beetles dance on poop balls to keep cool

Dung beetles can use balls of poo much like air-conditioning units to cool themselves, researchers say.

Dung beetles roll up nutritious balls of excrement up to 50 times heavier than their own bodies to feed their young. They roll the balls walking backward, with their heads near the ground. The ancient Egyptians envisioned that the sun was rolled around the sky in much the same way, making the dung (or scarab) beetle an important symbol in ancient Egyptian religion.

Past research showed these insects routinely dance in circles on top of their feasts of dung to help navigate away from rival beetles as quickly as possible. As scientists looked for this dancing, they noticed the beetles climbed onto the excrement balls most often during the midday heat.

Now researchers find that dung beetles might also use excrement to keep themselves cool.

"Dung beetles are the first example of an insect using a mobile, thermal refuge to move across hot soil," researcher Jochen Smolka, a neuroethologist at Lund University in Sweden, told LiveScience. "Insects, once thought to be at the mercy of environmental temperatures, use sophisticated behavioral strategies to regulate their body temperature[s]."

Scientists used thermal vision cameras to watch the Scarabaeus (Kheper) lamarcki dung beetle in its natural habitat in the South African savanna, where ground temperatures at noon can exceed a searing 140 degrees F (60 degrees C). The scientists prepared two sandy, circular arenas 10 feet wide. They kept one shaded in the morning so that it only reached a relatively cool 124.3 degrees F (51.3 degrees C), and left the other exposed to full sunlight so it heated up to about 135 degrees F (57.2 degrees C).

The researchers discovered that beetles on hot soil climbed onto their excrement balls seven times more often than when on cooler ground. When the researchers painted rubbery boots made of silicone onto the legs of the insects to protect them from the heat, "beetles with boots on climbed their balls less often," Smolka said. The scientists think the insects get on top of dung when it gets hot to give themselves a respite from scorching sands and help protect their brains from overheating. The researchers found the front legs of the beetles cooled by about 12 degrees F (7 degrees C) on average within 10 seconds of climbing on their excrement balls. "Like an air-conditioning unit, the moist ball is cooled by evaporative cooling," Smolka said.

Once on top of the balls, the insects were often seen "wiping their faces," preening gestures the investigators think spread regurgitated liquid onto their legs and heads, behavior never seen at other times of day.

"We'd really like to continue looking at the preening behavior," Smolka said. "Do the beetles actually regurgitate liquid in order to cool their heads?"

The scientists detailed their findings in the Oct. 23 issue of the journal Current Biology.

American Academy of Pediatrics weighs in for first time on organic foods for children

ScienceDaily (Oct. 22, 2012) ? Parents know it's important for children to eat a wide variety of fruits and vegetables, low-fat dairy products, and whole grains. But it's less clear whether spending the extra money on organic foods will bring a significant benefit to their children's health.

To offer guidance to parents -- and the pediatricians caring for their children's health -- the American Academy of Pediatrics (AAP) has conducted an extensive analysis of scientific evidence surrounding organic produce, dairy products and meat. The conclusion is mixed: While organic foods have the same vitamins, minerals, antioxidants, proteins, lipids and other nutrients as conventional foods, they also have lower pesticide levels, which may be significant for children. Organically raised animals are also less likely to be contaminated with drug-resistant bacteria because organic farming rules prohibit the non-therapeutic use of antibiotics.

However, in the long term, there is currently no direct evidence that consuming an organic diet leads to improved health or lower risk of disease. No large studies in humans have been performed that specifically address this issue.

"What's most important is that children eat a healthy diet rich in fruits, vegetables, whole grains, and low-fat or fat-free dairy products, whether those are conventional or organic foods. This type of diet has proven health benefits," said Janet Silverstein, MD, FAAP, a member of the AAP Committee on Nutrition and one of the lead authors of the report. "Many families have a limited food budget, and we do not want families to choose to consume smaller amounts of more expensive organic foods and thus reduce their overall intake of healthy foods like produce."

The AAP report, "Organic Foods: Health and Environmental Advantages and Disadvantages," was released on Oct. 22 at the AAP National Conference & Exhibition in New Orleans. It will be published in the November 2012 issue of Pediatrics (published online Oct. 22). The report outlines the research that has been conducted on organic foods, including convincing evidence of lower exposure to pesticides and less contamination of livestock with drug-resistant bacteria.

"At this point, we simply do not have the scientific evidence to know whether the difference in pesticide levels will impact a person's health over a lifetime, though we do know that children -- especially young children whose brains are developing -- are uniquely vulnerable to chemical exposures," said Joel Forman, MD, FAAP, a member of the AAP Council on Environmental Health and one of the lead authors of the AAP clinical report.

If cost is a factor, families can be selective in choosing organic foods, Dr. Forman said. Some conventionally grown fruits and vegetables tend to have lower pesticide residues. The AAP cites organic shopper's guides like those provided by Consumer Reports and the Environmental Working Group as references for consumers. The AAP found no individual health benefit from purchasing organic milk, but emphasizes that all milk should be pasteurized to reduce the risk of bacterial infections. Raw milk increases the risk of serious infection with bacteria including Salmonella, E. coli, Listeria, Campylobacter and Brucella.

Purchasing meat from organic farms that do not use antibiotics for nontherapeutic uses has the potential to reduce antibiotic resistance in bacteria that infect people. The AAP calls for large, well-designed, prospective cohort studies that directly measure environmental exposures such as estrogen at low levels to understand the impact of hormonal exposure of children through milk and meat.

The AAP report also notes that the motivation to choose organic produce, meat and dairy products may be reasonably based on larger environmental issues, as well as human health impacts like pollution and global climate change.

"Pediatricians want families to have the information they need to make wise food choices," said Dr. Forman. "We hope that additional research will improve our understanding of these issues, including large studies that measure environmental exposures and neurodevelopment."

LONDON (AP) -A football hooligan has been jailed for 16 weeks for attacking former England goalkeeper Chris Kirkland during a pitch invasion in a second-tier League Championship match.

Aaron Cawley, a 21-year-old from Cheltenham, pleaded guilty to charges of assault and entering the field of play when he appeared Monday at Sheffield Magistrates' Court.

Kirkland needed medical treatment after being shoved in the face and to the ground amid violent scenes during his Sheffield Wednesday side's match against Leeds at Hillsborough, which was broadcast live on British television on Friday

The Football Association has launched an investigation into the crowd trouble at the game, which also saw bottles being thrown onto the pitch and offensive chanting from both sets of fans.

currently unfolding, suggests the worlds top banks have been rigging the Libor rate for years, a rate by which interest rates on financial instruments everywhere are derived on a daily basis. Even worse, it appears that some of this activity must have been known about by regulators.

in London will hopefully raise a long overdue international discussion about the foundations of our global monetary system that should have taken place back in 2008.

That discussion involves a re assessment of the rights of banks to use their deposit base (clients money) as leverage for speculative activities like derivatives.

Originally in what was known as the Glass-Steagall standard (a piece of legislation originated by Roosevelt) a firewall was created between ordinary banking activities and other speculative investment activities.

However over time, (the 1990s in the US and the 1980s in the UK) that type of legislation was repealed and the underlying principles and reasons for the protection forgotten. The general economic philosophy of the day was that the merchant banking investment market was capable of self regulation and should be left to its own devices notwithstanding increasingly speculative activities.

We now know this is not the case. The banks derivatives obsession and focus on short term profit to lend primarily to non profit producing assets is what bankrupted banks, devastated the productive capacity of economies and left ordinary people to pay the bill resulting in alarming drops in standards of living.

The combination of highly speculative activity with traditional banking resulted in a loss of prudence, a necessary feature of banking and a heavy focus on sales - selling as much debt as possible to make as much short term profit as possible for banks. We shouldn't be surprised by this outcome. It is the underlying motivation of uncontrolled capitalist activity.
In fact, we are now seeing perhaps for the first time, that the end game of completely unfettered capitalism concentrates wealth into fewer and fewer hands making it the ultimate nemesis of a true democracy. The market crash and continuing fallout is driving the lesson home. It is counter intuitive to how we have previously thought.

The problem is that banks have almost total control of the monetary system. There is no benefit to the banks under the existing system in taking into account the long term effects of their lending decisions on society, only in how those decisions affect the profit or health of the bank itself.

The anger and rage echoing around the world now is that the wrong people are paying the price while the ones involved in the crisis continue to practice similar activities with impunity. This is the REAL issue with . It demonstrates dishonesty and unfairness in the existing system and how it's manipulated from the inside to favour a minority. It also brings home that for all the rhetoric and posturing of the last few years, nothing fundamentally about the system has changed.
What is needed now is an awareness of this and a radical and careful overhaul.

Banking as an activity is a necessary component of a healthy well functioning modern society; the idea being that people deposit their funds with banks then banks use those funds to make loans to other citizens for the purpose of economic growth and improving the overall standard of living in communities. Currently this is just a fairytale. The bulk of lending is to non profit producing assets (homes) that create no growth in an economy but provide the bank security if there's a default. These are seen by banks as easier and safer investments than more risky start up loans for new or even existing business's. Again we shouldn't be surprised by this trend because the banks primary goal is to protect itself from financial loss not grow a healthy economy.

For the system to function effectively, any depository institution needs to be highly regulated and work within a controlled framework of what is and what is not permissible. A Glass-Steagall 'type" of standard would protect legitimate deposit and commercial banking activities while allowing the more speculative activities to fail (because they would not be part of the banking system) without damaging innocent victims.

The real challenge right now is to make people aware of these stark realities, especially our policy makers and then to consider "how" this enormous decoupling process and overhaul of the banking system can best be carried out with the least amount of pain to everyone.

BP backs deal to swap TNK-BP for Rosneft stake

(AP) ? The board of U.K. energy company BP PLC has struck a deal to swap its profitable but troublesome Russian oil venture TNK-BP for a big stake in Rosneft, the Kremlin-controlled energy company, a person familiar with the matter said Sunday.

The person said that the sale of BP's half of TNK-BP was expected to net the company between $10 to $15 billion in cash as well as a 15 to 20 percent stake in Rosneft, Russia's largest producer of oil. The person said that the ranges were approximate because the parameters of the deal were still being worked out. He spoke on condition of anonymity before an official announcement which he said the companies hoped to make "soon."

Such a deal would allow BP to exit its troubled partnership with the consortium of Russian billionaires which controls the other half of TNK-BP while keeping a presence in Russia, a country responsible for producing nearly 10 million barrels of crude every day. But the deal would also bring the British company much closer to the Kremlin; Rosneft is run by former deputy prime minister Igor Sechin, a longtime aide to Russian President Vladimir Putin, and BP's shareholders may worry about the political dimensions of the deal.

Britain's The Sunday Telegraph said that five of BP's leading investors, which it didn't identify by name, had qualms about the move.

Rosneft declined to comment when reached by phone late Sunday.

In an effort to smooth things over with exiled customers, the company pledged that it would offer a $100 rebate to those who trade up to a select Motorola smartphone. Today, the Google-owned Android maker has released a list detailing which phones qualify for this promotion. If you're among the many who purchased a Droid 3, Droid X2 and Photon 4G, it looks like an official update to Android 4.1 is out of the question. It should be noted that this offer doesn't affect your wireless contract's terms and conditions (read: ETF may still apply). UFO Hovers For Hours Above Family Home In Scotland (VIDEO)

A family in Scotland was amazed to see a glowing unidentified flying object hovering in the sky in the middle of the night above their rural home -- and it stayed there for hours.

Morag Ritchie first noticed the odd, flickering and rotating lights when she woke up around 2 a.m. early Saturday.

"I saw what I thought was a bright star," Ritchie told BBC Scotland. "However, it was a sequence of flashing lights. There was also a darting light coming from the side. There was no sound, either."

Ritchie woke her family up and they all watched as a continuous moving stream of lights blinked in and out and around the strange object that reportedly remained in this location for several hours near their Fraserburgh, Aberdeenshire home.

"I just woke up all of a sudden and looked out of the window to see all these twinkling lights -- they looked like they were moving," Ritchie said, according to Yahoo News U.K.

As the unusual object just hung there silently, sometimes revealing as many as five individual lights turning on and off around its perimeter, the family captured its movements on video.

"My husband is a fisherman and he's spent many hours looking up at the night sky, so he was quite skeptical when I told him, but even he admitted it was strange," said Ritchie.

The video reveals, and Ritchie reported that, "occasionally, something shot off to the side. I kept going back to my bed but I was so unsettled that I continued waking up," according to STV Local.

The sighting lasted several hours, and by daylight, the mystery object was gone.

STV Local also reported that a Civil Aviation Authority spokesman, Richard Taylor, said, "We have no way of knowing what aircrafts were around that area at that time.

"There was a lot of activity with the northern lights -- the natural phenomenon -- wouldn't that be a more feasible explanation than an aircraft or UFO? If it was an aircraft, it would have been military," said Taylor.

Ozone affects forest watersheds

U.S. Forest Service and Oak Ridge National Laboratory (ORNL) scientists have found that rising levels of ozone, a greenhouse gas, may amplify the impacts of higher temperatures and reduce streamflow from forests to rivers, streams, and other water bodies. Such effects could potentially reduce water supplies available to support forest ecosystems and people in the southeastern United States.

Impacts of ozone, a global scale pollutant, on forests are not well understood at a large scale. This modeling study indicates that current and projected increases in ozone in the 21st century will likely enhance the negative effects of warming on watersheds, aggravating drought and altering stream flow. Using data on atmospheric water supply and demand and statistical models, researchers with the Forest Service and ORNL were able to show what effects ozone can have on stream flow in dry seasons. Published in the November issue of the journal Global Change Biology, the study suggests that ozone has amplified the effects of warmer temperatures in reducing streamflow in forested watersheds in the southeastern United States.

"From previous studies, we know a lot about ozone's influences on crops and leaves of young trees. However, no studies have investigated the impacts of ozone on water flow in large forested watersheds," says Ge Sun, research hydrologist with the Forest Service Eastern Forest Environmental Threat Assessment Center. "Our studies show that ozone has a possible connection in the reduction of streamflow in late summer when flow is generally lowest, particularly in areas with high ozone levels such as the Appalachian Mountains in the Southeast."

Researchers developed models based on 18 to 26 years of data and observed streamflow in response to climate and atmospheric chemistry during the growing season. The research team evaluated individual and interactive effects of ozone on late season streamflow for six southeastern forested watersheds ranging in size from 38 acres to more than 3,700 square miles. Estimates of ozone's influence on streamflow ranged from 7 percent in the area of lowest ozone in West Virginia to 23 percent in the areas of highest exposure in Tennessee.

The findings from this study along with a wide range of previous field studies challenge assumptions derived from small controlled studies that ozone exposure reduces water loss from trees and forests.The present study of mature forests under moderate ozone exposure shows that those ecosystems may react in a different way than can be predicted by short-range, intensive studies.

"We're predicting that forests under high ozone conditions will use more water instead of less, as was previously assumed," says Samuel "Sandy" McLaughlin, scientist emeritus from the ORNL Environmental Sciences Division. "The concern is that ozone-induced increases in plant water loss could aggravate drought impacts on forests, and reduce the water available for people and stream life dependent on water flow during the dry seasons."

Warner Bros. Wins Big Ruling in Superman Copyright Case

LOS ANGELES (TheWrap.com) - Warner Bros. is one step closer to owning the Man of Steel outright.

The company, which owns D.C. Comics, scored a substantial victory in U.S. District Court in Central California on Wednesday, as Judge Otis D. Wright granted DC's motion for partial summary judgment.

At issue was whether DC's agreement with Superman co-creator Joe Shuster's sister, Jean Peavy - Shuster's sole heir and estate executor - precludes a 2003 copyright termination notice filed by Shuster relative Mark Warren Peary. (Peary, Peavy's son, was named by Shuster as the executor of his estate should Peavy die or be unable to fulfill her duties as executor. Shuster died in 1992.)

The termination notice sought to recapture early Superman works on Oct, 26, 2013.

In his partial summary judgment, White found that the 1992 agreement overrides other agreements.

"In sum, the Court finds that the 1992 Agreement, which represented the Shuster heirs' opportunity to renegotiate the prior grants of Joe Shuster's copyrights, superseded and replaced all prior grants of the Superman copyrights," White's order reads. "As such, between November 10, 2003 (when the Notice was served) and October 26, 2013 (its effective date), DC was and is the only party that may enter into an agreement with the Shuster heirs regarding the Superman rights sought to be recaptured."

Warner's "Man of Steel," which stars Henry Cavill as the red-caped superhero, is slated for release on June 14, 2013.

Microsoft sells out of $499 Surface tablets

Microsoft has only?been letting people pre-order the new Surface RT tablet since Wednesday, but the most popular configuration ? the entry-level $499 one ? appears to be sold out?already.

Now, if you attempt to pre-order the baseline Surface with Windows RT, a 32 GB device without the new Touch Cover accessory, you'll have to wait about three weeks for it to ship, according to Microsoft's website.?

Oddly enough, if you choose to buy the same model with a bundled keyboard Touch Cover (the?one whose ease of use came as "a pleasant surprise" to?our own Wilson Rothman), you can still get it on the original ship?date of Oct. 26.?Entry-level configurations ordered before the change to the delivery timeframe should ship on time.

We've reached out to Microsoft for comment on this shipment delay, of course. We'd certainly?love to know how many Surface RT tablets have been pre-ordered total?so far, especially considering that the company is rumored to have ordered enough parts to make three to five million Surface tablets in this quarter alone.
